1.     Law On Earth is a public self-service platform which provides the ability for the public to manage their own legal needs in a secure, online environment.  The Site, Platform and/or App connects customers to advisors, provides the ability for customers to create documents, incorporate companies and provides education on a variety of topics.  In order to provide you with the best user experience and protect your interests and the interests of other members on our Site, Platform and/or App, we require all users to comply with the following Terms of Use and this Privacy Policy.

5.     This Privacy Policy sets out how Law On Earth AU Pty Ltd ACN 626 822 606 trading as Law On Earth of Level 54, 111 Eagle Street, Brisbane in the State of Queensland (“Law On Earth”, “Us”, “We”) collects, stores, uses, protects and shares your personal information.

 

6.     It applies to our platform at www.lawonearth.com (the “Site”) and any Law On Earth Application we create which connects to, or is in connection with, the Site (the “App”).

 

7.     By visiting or using the Site &/or App you agree to the collection, storage, usage and disclosure of your personal information by Us in the manner described in this Privacy Policy.

 

Amendments and deleting your information

 

8.     We reserve the right to amend this Privacy Policy at any time by posting the amended terms on the Site &/or App. If we make material changes to this policy, we will notify you by the Site &/or App or by a notice to any of the contact details you have provided when registering as a member of the Site &/or App so that you access and review the changes.

 

9.     If you object to any changes, you may:

(a)       discontinue your use of the Site &/or App; and/or

(b)       delete your membership under Settings in the App, in accordance with our Terms of Use; and

(c)        request that we delete your information.

 

10.   By continuing to use the Site &/or App after notice of changes has been sent to you or published on the Site &/or App, you are deemed to have consented to the changes.

 

How we collect Personal Information

 

11.   We collect personal information in a number of ways, including:

(a)       when you provide information directly to Us in person, by phone or in writing (whether electronic, via our communication tools or otherwise);

(b)       when you visit &/or use the Site &/or App, in which case, we record information sent to us by your computer, mobile device or other access device; and

(k)       personal information from your interaction with the Site &/or App and its content and advertising, including device identifiers, device type, geo-location information, connection information, statistics on page views, traffic to and from the Site &/or App, mobile network information, time, date, referring URL, the type of operating system and browser, ad data, IP address and standard web log data.

 

13.   You understand that the App will show only your picture, name, phone number and social media link that you logged in with, and that you may then edit your profile information.  You agree to not post or add personal data or information to your profile or account that you would not want to be publicly available.

14.   How We use your data will depend on the Services you use and how your use those Services.

 

15.   Our principal purpose in collecting, using and storing your personal information is to provide you with access to and use of the Site &/or App in a personalised, safe and efficient manner.

 

16.   You consent to us collecting, using, storing and sharing your personal information to:

(a)       Operate the Site &/or App, generate content and provide customer support and billing services (including updates and improvements);

(b)       provide the services requested by you;

17.   You may withdraw your consent to us collecting, storing, using and disclosing your personal information in accordance with this Privacy Policy, but you will not be permitted to continue to use the Site &/or App.

 

18.   You may opt out of receiving our marketing, advertising and promotional notices, offers and communications by communicating this to us by email.

 

19.   You may also request that we delete your information at any time.   

Disclosure to third parties

 

20.   Notwithstanding section 6 above, you agree that we may disclose your personal information to:

(f)        outsourced service providers who assist Us to provide its services such as information technology providers and marketing advisers (including in relation to fee collection, fraud investigations and Site &/or App operations);

(g)       third parties to whom you expressly ask us to send, or consent to us sending, your personal information;

(h)       credit agencies (including regarding missed and late payments or other defaults or breaches on your account); or

(i)         such entities that we propose to merge with or be acquired by and in such case, we will require that the new entity following the merger or acquisition adhere to this Privacy Policy.

We are not responsible nor liable for Linked Sites and recommends that you read the privacy policies of such Linked Sites before disclosing your personal information.

No Spam, Spyware or Spoofing

 

26.   You are prohibited from engaging in spam, spyware or spoofing type activities, regardless of whether directed towards Us or other users of Us.

 

27.   You must not use the Site &/or App to send, upload or distribute spam, viruses or malicious, illegal or prohibited content to the Site &/or App or otherwise send content that would breach our Terms of Use or this Privacy Policy.

 

28.   You are not permitted to add a user or member to our mailing list (postal or email details included) without the written consent of a user or member.

 

29.   We may (or we may engage a third-party service provider to) take steps to scan and filter messages to check for spam, viruses, phishing attacks and other malicious activity or unlawful or content prohibited by this Privacy Policy and our Terms of Use.

 

Storage and security

 

30.   We store and process your personal information on our host’s servers, currently located in multiple locations around the world. You consent to the transfer, storage and retention of that information onto the servers of our host provider used from time to time by Us, regardless of the location of those servers.

Hosting and International Data Transfers

48.   The hosting facilities for our website are situated in Australia.

 

49.   Our Suppliers and Contractors are currently in Australia, but may in the future be situated in Australia, UK, New Zealand, the Philippines and USA. Transfers to each of these Countries will be protected by appropriate safeguards, these include one or more of the following:
