In basic terms, a trade mark provides it’s registered owner with the exclusive right to use their trade mark or authorise another person or business to use their trade mark, in relation to the goods and services that it has been registered for. Trade Mark protection is provided by the Trade Mark Act 1995 (Cth) and Trade Mark Regulations 1995 (Cth). These acts outline an owner’s right to obtain relief if it their trade mark has been infringed.
What can you register as a trade mark?
Often trade marks will represent a brand or your business’ identity – at its core, it is how a customer would recognise your brand. Your trade mark may be a corporate logo, a jingle in an advertisement, a business name printed on a work vehicle, signage or packaging.

Can I register my business or company name?
Registering a trade mark is NOT the same as registering a business, company or domain name. Business and company names registration is managed [KR1] [GU2] [JC3] by the Australian Securities and Investments Commission (ASIC). This form of registration does not prevent others from using the same or similar name to you in their trade marks.
